Terms of Service
By using 5:23 you agree to these terms. They’re written to be read.
1. The app
5:23 is a routine, training and habit tracking app made by Portion Eight LLC, 17 Metropolitan Ave, North Bellmore, NY 11710 (“we”). You need to be at least 13 to use it (16 where local law requires), and if you’re under 18, a parent or guardian must agree to these terms.
2. Not medical advice
5:23 and its AI coach give general fitness, nutrition and routine guidance. They are not medical advice. Talk to a doctor before starting a new training or nutrition plan, and stop any exercise that causes pain. You train at your own risk.
3. Beta
During the beta the app is free, may have bugs and may change or lose features. Keep your own copy of anything you can’t afford to lose.
4. Subscriptions
After launch, 5:23 is a paid subscription, with plans starting at $4.99 a month. Payment is handled by Apple through your Apple ID. It renews automatically unless you cancel at least 24 hours before the period ends, in iPhone Settings › your name › Subscriptions. Refunds are handled by Apple.
5. Your content and the AI coach
What you log is yours. You let us store and process it to run the app. If you connect the AI coach through Claude, Anthropic’s terms also apply to that use. AI output can be wrong; use your judgment.
6. Fair use
Don’t misuse the app, try to break it, reverse engineer it or use it to break the law. We can suspend accounts that do.
7. Liability
The app is provided “as is.” To the extent the law allows, we aren’t liable for indirect or consequential damages, and our total liability is limited to what you paid us in the 12 months before the claim.
8. Changes, law, contact
We may update these terms and will change the date above when we do. These terms are governed by the laws of the State of New York. Apple’s standard EULA also applies. Questions: support@fivetwentythree.app.
